3) General Terms and Conditions of Trade
a) Product Description
i) For the majority of products, our suppliers provide us with product information which is uploaded onto the Website as downloadable specification sheets. Every care is taken by us to provide you with up-to-date and accurate data on the Website. Occasionally, however, human error can occur leading to incorrect product specifications, incorrect spelling and other inaccuracies.
If you find any such inaccuracies, please contact us as soon as you can so that we can address the issue
b) Allergies, Alcohol and Age Restricted Products
i) Products containing alcohol are not available for sale to those under the age of 18 and by ordering any products containing alcohol, you represent to us that you are at least 18 years of age.
ii) Allergy information can be found on the downloadable specification sheets
i) The price of the goods will be as quoted on the Website at the time you confirm your order subject only to any technical error for which we will not be liable.
ii) Occasionally human errors can occur leading to incorrect prices. If this happens we will contact you as soon as we can. At this juncture you can reconfirm your order at the correct price, or you can cancel.
iii) If we cannot cancel, we will honour your order with the incorrect price.
iv) We reserve the right to update prices displayed on the Website at any point.
i) All prices stated are in GBP. We cannot accept other currencies unless you pay by Pay Pal. Payment for your goods ordered from the Website can be via credit or debit cards. You may also pay by Pay Pal. We do accept cheques or cash as payment online, however, product is not released until these funds have been cleared. Please do not send us payment information using e-mail as we cannot guarantee the security your data.
ii) During the checkout process, you will be asked to enter your payment details. By completing your payment details you confirm that the credit or debit card being used is yours. All fields indicated as compulsory must be completed. All card payments are subject to authorisation by your card issuer. If authorised, your card issuer will hold this value expecting a charge from us. Receipt of your credit card details and debit of payments does not constitute our acceptance of your order.
e) The Agreement
i) By placing an order you are signifying that you are providing details which are true, accurate, current and complete. You also signify that these details are correct and are your own.
ii) All orders placed by you are subject to acceptance by us, which occurs when we dispatch the goods to you. The acknowledgement confirmation sent in response to your order is provisional and is intended only to indicate receipt of the order. We shall notify you by email in the event that we do not accept any order and any payment will be fully refunded.
f) Product Availability
i) We plan to hold sufficient mainline stock to satisfy your order. However if an item is out-of-stock, this is highlighted on the Website, where you will be invited to ‘Add to cart to pre-order’. If a temporary out-of-stock occurs, we will also advise you of that fact and of the anticipated delivery date and/or alternative products. If this is not satisfactory to you, you may cancel the order immediately. If the product is delayed by more than 30 days, we will contact you to check if you wish to continue with the order. If you do not, we will send you a full refund.
ii) We do not hold stock for short life products e.g. fresh meats. These products are ordered in as required.
iii) We reserve the right to change at any time the products and services advertised or made available for sale on the Website and/or to limit quantities available for sale.
i) We deliver to the UK mainland with an overnight service, and across the EU using DPD’s overnight courier delivery service.
ii) For mainstream products (i.e. not short life products): For orders placed before 14.00 Monday through to Thursday, we aim to dispatch your product within 24 / 48 hours after receipt of your order. Deliveries will generally reach you within 1 day of product dispatch, 2 days for orders being delivered to Scotland. However, we will not be held liable should delivery times exceed this time for circumstances which are out of our control. If the delivery is likely to be later than the 48 hours, a member of the Customer Service Team will contact you and advise you about the delivery date.
iii) Orders shipped using a Royal Mail delivery option will be sent with first class mail unless noted, and will be subject to Royal Mail’s normal terms and conditions for domestic post. We do not have any tracking ability of items sent with Royal Mail, however, we accept responsibility for any loss or damages that may occur when using this option.
iv) It is your responsibility to ensure that an appropriate person is available to receive and sign for the delivery on the day the goods arrive to the delivery address.
v) For short-life products: Short life products are ordered against customer orders. For orders placed before Wednesday 17.00 and despatched within 48 hours of receiving them in the warehouse. We are dependent upon our Danish wholesaler sending us the longest dates they have available. Short life products are bought on the understanding that they will reach you before their best-before date; we cannot accept returns. Please note that we cannot ship chilled products on Fridays unless a Saturday delivery has been arranged (at extra charge).
vi) Orders for perishable and chilled products will be packed in insulated boxes with ice packs which maintain required temperatures for up to 48 hours.
vii) Due to the nature of perishable and chilled products, our carriers will not return any unsigned for or undelivered deliveries. Options are offered to rectify how you wish delivery to be completed if you are not available. Without these details, we will not take responsibility or accept your order.
viii) In all instances our liability will be limited to the price of the goods not delivered, or incorrectly delivered, and the cost of delivery and any provable consequential losses as a result of our breach of contract.
ix) We will deliver the Goods to the Delivery Location by the time or within the agreed period or, failing any agreement, without undue delay and, in any event, not more than 30 days after the day on which the Contract is entered into or as agreed between the parties.
x) If you or your nominee fail, through no fault of ours, to take delivery of the Goods at the Delivery Location, we may charge the reasonable costs of storing and redelivering them.
h) International Deliveries
i) Prices for international delivery will be quoted on an individual basis based on location and weight. Any chilled products are shipped at your risk as we cannot guarantee the temperature-control during the extended transit. Please be advised that we cannot ship chilled goods or alcohol to the USA.
i) Receipt of Goods and Returns
i) For mainstream products: You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery, you should let us know as soon as you can. You may also send a letter by post to The Good Food & Gifts Company Ltd., Lacey House, High Street, Lavendon, Buckinghamshire, MK46 4HA, United Kingdom. Ideally we ask you to inform us within 7 days so that we can resolve the issues as soon as we can for you.
ii) The return address is: The Good Food & Gifts Company Ltd., Lacey House, High Street, Lavendon, Buckinghamshire, MK46 4HA, United Kingdom. We will replace or refund you for the incorrect / damaged item upon receiving the returned goods. We will also reimburse your postage costs.
iii) For short-life products: You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery, you should let us know as soon as you can. You can e-mail us at firstname.lastname@example.org or phone us on +44 (0)1234 240000, quoting the order number specified in our order acknowledgement. You may also send a letter by post to The Good Food & Gifts Company Ltd., Lacey House, High Street, Lavendon, Buckinghamshire, MK46 4HA, United Kingdom. Ideally we ask you to inform us within 24 hours given the short shelf-life of the product.
iv) The return address is: The Good Food & Gifts Company Ltd., Lacey House, High Street, Lavendon, Buckinghamshire, MK46 4HA, United Kingdom. We will replace or refund you for the incorrect / damaged item upon receiving the returned goods. We will also reimburse your postage costs
v) We recommend that you gain a Proof of Postage from your Post Office as proof that you have sent the items back to us. This is a free service
j) Cancellation By You
i) You have the right to cancel an order (a) before receiving any goods or (b) up to 14 days after the day on which the goods come into your physical possession (or the authorised recipient of the goods).
ii) To exercise your right to cancel, you should inform us of your decision by a clear statement. You may also send a letter by post to The Good Food & Gifts Co. Ltd., Lacey House, High Street, Lavendon, Buckinghamshire, MK46 4HA, United Kingdom.
iii) We will reimburse you no later than 14 days after the day on which we are informed about your decision to cancel this contract.
iv) If you have received goods before notifying us of your wish to cancel, you must send the goods back to us at the above address without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation to us.
v) In the event that the goods were dispatched to you prior to receiving the cancellation, we will make the reimbursement to you without delay, and no later than:
– 14 days after the day we receive back from you any goods supplied, or
– (if earlier) 14 days after the day you provide evidence that you have returned the goods
vi) We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressively agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement
vii) The reimbursement does not cover your return cost of postage
viii)We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. You are only liable for any diminished value of goods resulting in the handling other than what is necessary to establish the nature, characteristics and functioning of the goods
ix) Please note that the right to cancellation does not apply to: (a) perishable and chilled goods; and (b) for health protection and hygiene reasons, sealed items where the seal is broken.
i) You have certain rights as a consumer. For further information about your legal rights in the UK, contact the Citizens Advice Consumer Helpline on 03454 040506 Nothing in these General Terms and Conditions will affect these legal rights and, in particular, we will perform our obligations under these General Terms and Conditions with reasonable care and skill.
ii) Any products we supply to you will be of satisfactory quality. If we deliver a product to you that is not of satisfactory quality, you have a 30 day right to reject the goods. We will send a replacement or a refund as you so request upon receipt of the goods (see Section i for details)
iii) We are only responsible for losses that are a natural, foreseeable consequence of our breach of these General Terms and Conditions. We will not be liable to you if we are prevented or delayed from complying with our obligations under these General Terms and Conditions by anything you (or anyone acting on your behalf) does or fails to do or due to events which are beyond our reasonable control.
i) If any provision of these Terms and Conditions is held to be invalid or unenforceable for any reason, then the provision will be deemed to be severed from this agreement and the remaining provisions will continue in full force and effect.
